US COURT REJECTS DISCOVERY REQUEST AGAINST TINUBU,DCI GROUP IN FOIA CASE

‎
‎A United States District Court for the District of Columbia has rejected a request by Aaron Greenspan seeking permission to obtain limited discovery from President Bola Tinubu and DCI Group in an ongoing Freedom of Information Act (FOIA) lawsuit.
‎
‎In its ruling delivered on October 30, 2026, the Court held that the proposed discovery concerning alleged cyberattacks on Greenspan’s website was not relevant to the underlying FOIA dispute involving the Federal Bureau of Investigation (FBI) and the Drug Enforcement Administration (DEA).
‎
‎The Court also rejected a separate application by non-party Karl Von Batten seeking permission to submit an amicus curiae ‘friend-of-the-court’ brief, as well as Greenspan’s related request for judicial notice.
‎
‎Additionally, the Court denied Greenspan’s motion for summary judgment in the case.
‎
‎Reacting to the ruling, counsel, Christopher W. Carmichael, said the decision reinforced the principle that FOIA proceedings should remain focused on the legal issues properly before the Court.
‎
‎He noted that the request for discovery against President Tinubu and DCI Group sought to introduce matters that were not sufficiently connected to the underlying FOIA dispute.
‎
‎Another counsel, Oluwole Afolabi, said the Court’s decisions established important procedural boundaries, although the substantive FOIA issues remained before it, adding that the ruling does not determine the outstanding issues in the Freedom of Information Act case involving the FBI and DEA, but addresses the discovery and other procedural applications brought before the Court.
