A Chief Magistrate Court sitting in Ado-Ekiti has sentenced two men, Adebiyi Olusola and Oguntola John, to 30 days’ imprisonment for public nudity.
Chief Magistrate Abayomi Adosun handed down the sentence on Wednesday without an option of fine, after the defendants pleaded guilty to a one-count charge of conduct likely to cause a breach of the peace. The court held that the prosecution had proved its case beyond reasonable doubt, adding that the guilty plea further strengthened the case against them.
Prosecutor ASP Akinwale Oriyomi told the court that the convicts committed the offence on July 13 at about 4:00 a.m. in the Palace area of Ado-Ekiti. He said they were seen walking naked around the palace vicinity and along a public highway within the Ado-Ekiti Magisterial District.
Oriyomi argued that their conduct was capable of causing a breach of public peace, contrary to Section 181(1)(d)(h) of the Ekiti State Laws, 2021. The defendants were subsequently arrested and arraigned.
The defendants’ counsel, Ogunleye Abiola, appeared on their behalf during the proceedings.
