The Court of Appeal sitting in Ado EKITI has affirmed the election of Mr Biodun Oyebanji of the All progressives Congress as the duely elected Governor of the state.
The court in its unanimous decision dismissed the appeal filed by former Governor Segun oni and SDP challenging the judgement of the Election Petitions Tribunal which upheld the election of the incumbent Mr Biodun Oyebanji as the Governor of the state.
The three man justices of the court of appeal resolved all the issues formulated for determination against the SDP and segun oni and subsequently dismissed the appeal for lacking merit.
The Court of Appeal agreed with the tribunal that the appealant failed to proved that the qualifications submitted to INEC by the Deputy Governor were forged stressing that it was idle to contend that a document was forged without the issuance of disclaimer by the issuing authority.
The Court held that the evidence of the second petitioner witness at the tribunal was eroneous and frivolous affirming that the lower court was right in its desicion to struck out such evidence in the determination of the petition.
The appealate court who awarded cost of 200,000 against the appealant said the appeal filed by the SDP.and its Governorship candidate Chief Segun oni failed and subsequently struck out.
