An Ekiti State high court sitting in Ado Ekiti has sentenced a 19 year old Ademola Oluwaseun to life imprisonment.
In his judgment, Justice Lekan Ogunmoye said, though, the defendant was charged for offence of armed robbery but evidence before the court only established offence of attempted armed robbery against him, in that, there was no evidence that he succeeded in stealing anything from his victim adding that the sole issue for determination is resolved partly in favour of the prosecution.
“I reiterate that the defendant is convicted for the offence of attempted armed robbery. He is sentenced to life imprisonment.”
According to the charge, the offence was committed on 6th May, 2017 at Idolofin Area of Ado Ekiti when the defendant armed with gun and robbed one Arowolo Suleiman of his Bajaj motorcycle with registration number (OGUN)LAR 223 VC, contrary to sec.402(2) of the criminal code Law, CAP.C16 laws of Ekiti State of Nigeria 2012.
In his testimony, the victim said, he is a commercial motorcyclist, he conveyed the defendant and one other, now at large, from Oke-Ila to Idolofin around 6:30am, on getting there, one of them pointed gun at him and was commanded to laid face down inside a drainage, before they escaped with the motorcycle, he stood up and pushed them away on the motorcycle, his shouting for help attracted nearby dwellers who gave them hot chase that led to arrest of the defendant while the other man escaped .
To proof his case, the prosecutor, Dolapo Oyewole called three witnesses and tendered, bond to produce motorcycle, statement of the defendant, pictures, some amount of money among others as exhibits while the defendant spoke through his counsel, Yinka Opaleke who pleaded court to temper justice with mercy and called one witness.
