The Supreme Court has struck out an appeal filed by the Allied People’s Movement against the election of Governor Siminalayi Fubara of Rivers State.
Counsel to the APM and its candidate, Innocent Kere decided to withdraw the appeal and the Court, led by Justice Kudirat Kekere-Ekun subsequently struck out the case.
However, the Supreme Court has reserved judgement in the appeal filed by the All Progressives Congress APC and its candidate, Patrick Tonye-Cole.
The court decided to reserve judgement after listening to arguments by all the parties involved.
Tonye-Cole claimed that Governor Fubara did not resign as Accountant-General of Rivers State within the stipulated deadline given by the Constitution and the Electoral Act.
Both the Election Tribunal and Appeal Court had earlier upheld the election of Governor Fubara.
